Kentucky Air Pollution Control Commission.

The Kentucky Air Pollution Control Commission was established in the Department of Health in 1966 under KRS 224.310-224.420 and charged with preventing and controlling air pollution in the state.

The commission functioned to develop a comprehensive plan for the prevention, abatement, and control of air pollution; to establish and amend ambient air quality standards and pollutant emission standards; to formulate rules and regulations concerning air quality; to prohibit the installation of equipment that could contribute to air pollution, or to grant permits for equipment that might effect air quality; to grant exemptions in regards to following the commission's regulations if emissions were not a threat to public health and safety; and to hold hearings. The commission also worked with other state governments and Kentucky local governments on air pollution problems, including reviewing local district air pollution control programs; and with the federal government in applying for and receiving any available funds for air pollution control.

Created in 1966 (Acts, ch. 22, sec. 2), the commission consisted of eleven members, including the commissioners of the Departments of Health, Commerce, Natural Resources, and Agriculture, and the Attorney General. The remaining six members were appointed by the governor for four year terms. They were to include three members representative of industry who had experience with air pollution control, one of whom was to be a licensed professional engineer; a representative from the University of Kentucky College of Engineering; and a representative of a local air pollution control district.

The commission was abolished on January 1, 1973 (Acts, 1st Ex. Session, 1972, ch. 3, sec. 8) and all its duties and functions were assumed by the newly-created Department of Environmental Protection.
